SHORT-TERM RENTAL AGREEMENT

This Short-Term Rental Agreement (“Agreement”) is entered into between Chaleco Properties LLC (“Host”) and the individual completing the booking (“Guest” or “Tenant”). By completing a reservation, Guest agrees to all terms outlined below. This Agreement is legally binding under the laws of the State of Texas.

1. PROPERTY DETAILS

This Agreement applies to the following properties:

506 Mark St, Pleasanton, TX 78064
108 Rawhide Ridge, Pleasanton, TX 78064
57 Drowsy Lane, Brookeland, TX 75931
Rayburn Property (if applicable)

Maximum Overnight Occupancy: 6 persons (strictly enforced)

Only individuals listed on the reservation are permitted on the property at any time. Day visitors exceeding reasonable occupancy may be considered an unauthorized gathering and may result in immediate termination without refund.

Guest must be 25 years or older to book and must occupy the property during the stay.

2. PAYMENT, FEES & TAXES

Full payment is due at the time of booking unless otherwise agreed for extended stays.

Cleaning Fee:
• $125 per stay for reservations under 30 days
• $180 per stay for reservations 30 days or longer

Occupancy Taxes (Short-Term Stays Only):
A total of 13% (6% Texas State + 7% local) applies to stays under 30 days.
Stays of 30 days or longer are not subject to occupancy taxes, in accordance with Texas law.

Failure of payment processing invalidates the reservation.

2A. SECURITY DEPOSIT

A refundable security deposit may be required at Host’s discretion, depending on the length of stay, booking type, and risk profile of the reservation.

If required, the deposit will be disclosed prior to booking and may be collected to cover:

• Property damage
• Missing items
• Excessive cleaning
• Unauthorized guests
• Smoking violations
• Tampering with systems
• Policy violations

If a deposit is collected, it will be returned within 5–7 days after checkout, provided no issues are identified.

Guest authorizes Host to:

• Retain any portion of the deposit as necessary
• Charge the credit card on file for damages exceeding the deposit (where permitted by law)

Documentation of damages will be provided.

3. STRICT NO-REFUND POLICY

All bookings are final and non-refundable unless otherwise stated in writing.

No refunds will be issued for:

• Cancellations for any reason
• Early departures
• No-shows
• Illness
• Weather
• Travel interruptions
• Utility outages beyond Host control

Travel insurance is strongly recommended.

4. CHECK-IN / CHECK-OUT

Check-in time: 4:00 PM
Check-out time: 10:00 AM

Late checkout without written approval will result in a $100 per hour fee and may result in additional charges if it impacts subsequent guests.

5. HOUSE RULES

No parties, events, or gatherings.
No smoking or vaping indoors. $500 violation fee plus remediation costs.
No pets or animals permitted under any circumstances due to severe owner allergies. Unauthorized animals will result in a $500 violation fee plus cleaning charges.
Quiet hours: 10:00 PM – 8:00 AM.
No moving furniture.
No tampering with smart locks, WiFi, cameras, thermostats, or utilities.
Trash must be bagged and placed in designated bins.
Grill must be cleaned after use.

6. NO ANIMAL POLICY

Due to documented severe owner allergies, no animals of any kind are permitted on the premises. This includes emotional support animals.

Service animals required under federal law must be disclosed prior to booking and may be subject to additional cleaning protocols.

Unauthorized animals will result in:

• Immediate termination of stay
• $500 violation fee
• Additional cleaning or remediation charges

7. DAMAGES & PROPERTY CONDITION

Guest agrees to leave the property in the same condition it was found.

Excessive mess, stains, odor, or damage will result in additional charges.

Guest must notify Host within 2 hours of check-in of any pre-existing issues. Failure to do so constitutes acceptance of the property condition.

8. RIGHT OF ENTRY

Host may enter with reasonable notice for maintenance, inspection, or showings.

Immediate entry is permitted in emergencies or suspected violations.

9. PROPERTY SHOWINGS & SALE STATUS (APPLIES TO LISTED PROPERTIES)

Guest acknowledges that certain properties, including the Rayburn property, may be actively listed for sale during the rental term.

Guest agrees to reasonably accommodate showings under the following conditions:

• A licensed real estate agent may access the property for showings with a minimum of 24 hours’ notice
• Showings will occur during reasonable daytime hours whenever possible
• Guest agrees to maintain the property in a clean, neat, and show-ready condition at all times, including:
  – Beds made
  – Dishes cleaned and put away
  – Trash removed
  – Floors and surfaces free of clutter
  – General appearance comparable to move-in condition

Host will make reasonable efforts to coordinate showings to minimize disruption.

Failure to allow access for properly noticed showings or failure to maintain show-ready condition may be considered a violation of this Agreement.

Repeated refusal to accommodate showings may result in termination of the month-to-month rental arrangement.

10. SECURITY & MONITORING

Exterior security cameras may be in use.

No interior cameras are installed.

Tampering with cameras, locks, or internet systems will result in immediate eviction.

11. LIABILITY & INDEMNIFICATION

Guest assumes all risk for injury, loss, or damage arising from use of the property.

Guest agrees to indemnify and hold harmless Chaleco Properties LLC from any claims, liabilities, or expenses arising from Guest’s use of the property.

Use of stairs, grills, decks, and outdoor areas is at Guest’s own risk.

12. HOLDOVER

Failure to vacate at checkout time constitutes trespass.

Host reserves the right to involve law enforcement.

13. FORCE MAJEURE

Host is not liable for interruptions caused by events beyond reasonable control including but not limited to:

• Weather
• Natural disasters
• Power outages
• Internet outages
• Government actions

No refunds will be issued in such cases.

14. LEGAL COMPLIANCE

Guest agrees to comply with:

• Texas law
• Local ordinances
• HOA rules (if applicable)

Violation may result in termination without refund.

15. ATTORNEY FEES & COLLECTION

In the event of legal action to enforce this Agreement, the prevailing party shall be entitled to reasonable attorney’s fees and costs.

16. GOVERNING LAW

This Agreement is governed by Texas law.

Venue for disputes shall be in the county where the property is located.

17. ACCEPTANCE

By completing a booking, Guest acknowledges:

• They have read this Agreement
• They understand the terms
• They agree to comply
• They authorize charges as outlined

No physical signature is required.

18. MONTH-TO-MONTH TERM & TERMINATION

This Agreement is considered a month-to-month short-term rental arrangement unless otherwise specified in writing.

Either Host or Guest may terminate this Agreement for any reason with a minimum of 30 days’ written notice.

Host reserves the right to terminate this Agreement with 30 days’ notice in situations including, but not limited to:

• Sale of the property
• Owner occupancy
• Change in property use
• Repeated violations of this Agreement
• Failure to maintain required condition (including show-ready condition)

In the event of termination:

• Guest agrees to vacate by the specified date
• Any unpaid balances must be satisfied prior to departure
• No refunds will be issued for unused time unless otherwise agreed

If Guest fails to vacate after proper notice, Guest may be considered a holdover occupant and subject to removal in accordance with Texas law.

Host may also terminate with less than 30 days’ notice if required to meet contractual obligations related to the sale of the property.

19. NO TENANCY / LICENSE TO OCCUPY ONLY

This Agreement is a short-term rental license agreement and does not create a landlord-tenant relationship.

Guest acknowledges that their stay is temporary and that no leasehold interest or tenancy rights are created, regardless of length of stay.

Occupancy is granted solely as a revocable license subject to this Agreement.

20. COOPERATION WITH SALE OF PROPERTY

Guest agrees to cooperate with the sale of the property and not interfere with showings, inspections, appraisals, or marketing.

Guest agrees to:

• Allow showings with proper notice
• Maintain show-ready condition
• Accommodate inspections and walkthroughs

Failure to cooperate may be considered a material violation of this Agreement.
